FluxGate Ventures LLC ("FluxGateAI," "we," "us," or "our"), a limited liability company registered in the State of Washington, operates the website at fluxgate.ai and related products, applications, and services (collectively, the "Services"). This Privacy Policy explains how we collect, use, store, and share information when you use the Services. By using the Services, you acknowledge that you have read and agree to this Privacy Policy. This Privacy Policy should be read together with our Terms of Service.

Information we collect

Information you provide directly

When you use the Services, you may provide us with personal information including but not limited to:

  • Your name, email address, and account credentials
  • Documents, files, images, and other materials you upload
  • Text, messages, and other content you submit through the Services
  • Professional, personal, or demographic information you provide
  • Preferences, settings, and feedback
  • Any other information you choose to upload or submit

Automatically collected information

When you visit the Site, our servers may automatically log standard technical information such as your IP address, browser type, operating system, referring URL, pages visited, and timestamps.

Information we do not collect

The Services are not designed to collect consumer health data as defined by the Washington My Health My Data Act (RCW 19.373) or similar health privacy statutes. You should not submit health-related information through the Services. See Section 6 of our Terms of Service for more details.

How we use your information

We use the information we collect for the purposes described in our Terms of Service, including but not limited to:

  • Providing, maintaining, and improving the Services
  • Developing, training, testing, and evaluating artificial intelligence models, algorithms, and systems (including benchmarks, evaluations, and fine-tuning)
  • Conducting internal research and development
  • Generating aggregate, anonymized, or de-identified datasets
  • Building new products, features, or services
  • Matching you with relevant third parties or opportunities
  • Contacting third parties on your behalf where we identify a potential match or opportunity relevant to your profile or use of the Services
  • Communicating with you about the Services, opportunities, or related offerings
  • Complying with legal obligations

Sharing and sale of your information

We may share your information, including content you submit, with third parties in the following circumstances:

  • Third-party matching: We may share your information with prospective partners, employers, clients, or other relevant third parties if we identify a potential match or opportunity based on your profile or use of the Services. Where we receive compensation or other valuable consideration in connection with such sharing, this may constitute a "sale" or "sharing" of personal information under applicable privacy laws, including the California Consumer Privacy Act (CCPA/CPRA)
  • Service providers: We may share information with third-party vendors who assist us in operating the Services, subject to confidentiality obligations
  • AI and research partners: We may share anonymized or aggregated data with research collaborators for AI development purposes
  • Legal requirements: We may disclose information when required by law or to protect our legal rights
  • Business transfers: In connection with a merger, acquisition, or sale of assets, your information may be transferred as a business asset

Notice of financial incentive

Certain features of the Services are provided to you at no monetary cost. In exchange, you consent to our collection, use, and sharing of your personal information as described in these policies, including sharing with third parties for compensation (such as employer matching or referral arrangements). This constitutes a "financial incentive" program under the California Consumer Privacy Act (CCPA/CPRA).

What you receive: Access to the Services, including AI-powered tools, matching, and other features, at no charge.

What we receive: The ability to use, analyze, and share your personal information and User Content as described in these policies and our Terms of Service, including sharing with third parties where we may receive compensation or other valuable consideration.

How we estimate value: We estimate the value of your data based on the reasonable costs of providing the Services, including infrastructure, AI model development, and operational expenses, offset by the revenue generated through data sharing arrangements. The value of the financial incentive is reasonably related to the value of your data to our business.

Opt-in and withdrawal: By creating an account or using the Services, you opt in to this financial incentive program. You may withdraw from the program at any time by contacting legal@fluxgate.ai with the subject line "Withdraw from Financial Incentive Program." Because the free Services are provided in exchange for your participation in this program, withdrawing will result in the termination of your access to the affected Services.

Your opt-out rights (Do Not Sell or Share)

Under the California Consumer Privacy Act (CCPA/CPRA) and similar state laws, you may have the right to opt out of the sale or sharing of your personal information. You can exercise this right by:

  • Submitting a written request to legal@fluxgate.ai with the subject line "Do Not Sell or Share My Personal Information"
  • Using a browser or browser extension that transmits a Global Privacy Control (GPC) signal

We honor Global Privacy Control (GPC) signals as legally binding opt-out requests for the sale or sharing of personal information where required by applicable law. If we detect a GPC signal from your browser, we will treat it as a valid request to opt out.

If you opt out of data selling or sharing, we will cease sharing your personal information with third parties for compensation. Because the free Services are offered as a financial incentive in exchange for your participation in data sharing (see "Notice of financial incentive" above), opting out may result in the termination of your access to the affected Services. This opt-out does not affect sharing that is necessary to provide the Services (such as with service providers), sharing of de-identified or aggregated data, or disclosures required by law.

Data retention

We retain information as necessary to fulfill the purposes described in this policy and our Terms of Service, subject to applicable law. For more details, see Section 12 of the Terms of Service.

Data deletion

You may request deletion of your identifiable personal information by submitting a written request to legal@fluxgate.ai. Your request must include your full name, the email address associated with your use of the Services, and a specific description of the data you are requesting to be deleted. Incomplete requests may not be processed until the required information is provided.

We will use commercially reasonable efforts to process complete deletion requests within ninety (90) days. Deletion applies to identifiable personal information held directly by FluxGate Ventures LLC only — server logs, system metadata, anonymized or de-identified data, and derived outputs (such as model weights and training artifacts) are not subject to deletion requests. Data that has already been shared with or transmitted to third parties (including employers, partners, and service providers) prior to your deletion request or during the ninety (90) day processing period is not covered — data may continue to be shared through automated processes while your request is being fulfilled. We are not responsible for and have no obligation to delete data held by third parties. For full details, see Section 12 of the Terms of Service.

Cookies and tracking

We use Google Analytics to understand how visitors interact with the Site. Google Analytics uses cookies and similar technologies to collect information about your use of the Site, including pages visited, time spent, and referring URLs. This data is processed by Google in accordance with its Privacy Policy. You can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on.

We may introduce additional cookies or tracking technologies in the future, at which point this policy will be updated.

Do Not Track and Global Privacy Control

Some browsers offer a "Do Not Track" (DNT) setting. Because there is no accepted standard for how to respond to DNT signals, the Site does not currently respond to DNT signals.

We do honor Global Privacy Control (GPC) signals, which serve as a legally recognized opt-out mechanism under the CCPA/CPRA and other applicable state privacy laws. Security

We take the security of your information seriously and use industry-standard technical and organizational safeguards to protect it. While we work hard to keep your data safe, no system is perfectly secure — so we continuously review and improve our practices to stay ahead of emerging threats.

Age requirement

The Services are intended for users who are at least 18 years old. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected information from a user under 18, we will take steps to delete that information promptly.

Your rights under applicable law

Depending on your state of residence, you may have additional rights regarding your personal information under applicable law, including the Washington Consumer Protection Act (RCW 19.86) and other state consumer protection and privacy statutes. Nothing in this Privacy Policy or our Terms of Service is intended to limit any rights that cannot be waived by contract under applicable law.

Changes to this policy

We may update this Privacy Policy at any time. Changes will be posted on this page with a revised effective date. Your continued use of the Services after any changes constitutes acceptance of the updated policy.
